Toxic Torts / Environmental / Habitability
The manufacture, use, and disposal of certain chemicals and other substances have prompted claims of wide-ranging physical injury and property damage. These claims are classified as types of “toxic torts.” They involve substances such as asbestos, benzene and PCB. More recently, in claims related to construction defects, “sick building” allegations are arising more and more.
Environmental hazards in residential rental properties caused by mold contamination, as well as, the presence of lead paint are becoming increasingly prevalent and can turn seemingly small tenant habitability claims into catastrophic personal injury losses. We are experts in the handling of such tenant claims, both large and small.
